Terms & acceptable use
The agreement between you and Thoughtz, and the rules about what can be asked and answered.
Terms of service & EULA
The short version. This summary helps you find your way around. It does not replace the terms below.
- Part A applies to everyone. Part B applies if you run Surveys for a business. Part C applies if you use the Thoughtz App to answer or ask questions.
- Answers given through Thoughtz, and the results built from them, belong to Thoughtz. We use them only in aggregated form, and we never disclose who gave an answer.
- Every Survey is checked by an automated system, which uses AI, before it is published. Anyone answering a Survey can flag a question as inappropriate, and flags are reviewed by a person.
- If a Survey's results are public, the people who answered it can talk about it in a discussion, under a handle we make up for them rather than their name. Posts are not checked before they appear. Anyone who can see a post can report it, and a person at Thoughtz reviews every report. Your posts are deleted when you delete your account.
- Businesses pay only for what they choose to buy: extra Survey slots, add-ons and credits. There are no subscriptions, and credits do not expire.
Part A — Terms for everyone
1. About this Agreement
- 1.1This Terms of Service and End User Licence Agreement (Agreement) is between Thoughtz Pty Ltd ACN 626 307 177 of Level 1, 241 Adelaide St, Suite #1187, Brisbane QLD 4000 (Thoughtz, we, us, our) and you (you, your).
- 1.2It governs your use of the Platform, which means:
- (a) the Thoughtz App, whether installed from the Apple App Store or used in a web browser (App);
- (b) the Thoughtz business portal used to create and manage Surveys (Business Portal);
- (c) Thoughtz Codes, thoz.io short links and any other link or code that opens a Survey; and
- (d) the website at thoughtz.com, and any service we provide through any of them.
- 1.3Part A applies to everyone who uses the Platform. Part B also applies if you register or use a business account. Part C also applies if you register or use an App account. If a term in Part B or Part C conflicts with Part A, the term in Part B or Part C prevails to the extent of the conflict.
- 1.4Our Privacy Policy and Acceptable Use Policy, both published on our website and in the App, form part of this Agreement.
- 1.5You accept this Agreement by ticking or clicking "I agree" (or similar) when you register, or by otherwise using the Platform. If you do not agree, you must not use the Platform.
- 1.6You must be at least 14 years old to register an App account. If you are under 18, you confirm that your parent or guardian has read and agreed to this Agreement on your behalf. You must be at least 18, and authorised to act for the business, to register a business account.
2. Definitions
- Aggregated Results
- Results that are combined across Respondents, such as totals, percentages, averages, trends or demographic breakdowns, and that do not identify any individual Respondent.
- AI Features
- features of the Platform that use artificial intelligence, described in clause 6.
- App User
- a person with an App account.
- Business
- a person or organisation with a business account, and anyone using that account on its behalf.
- Credits
- Response Credits, AI Analysis Credits and any other prepaid credits we offer.
- Discussion
- the area in the App, attached to a Survey whose Results are public, where the people allowed in by clause C6 can read and write Posts about that Survey.
- Flag
- a report by a Respondent that a Survey question is inappropriate.
- Handle
- the name shown on an App User's Posts. We create it automatically from two words and a number, and it is not based on the App User's name.
- Post
- anything written in a Discussion, including a reply. A Post is not a Response and does not form part of Results.
- Respondent
- a person who answers a Survey.
- Response
- any answer a Respondent gives to a Survey, including ratings, choices and free text, together with the demographic information attached to it (such as gender and birth year) and the time it was given.
- Results
- all Responses to a Survey and everything derived from them, including charts, statistics, Aggregated Results and AI-written analyses.
- Survey
- a set of questions published through the Platform, whether by a Business or an App User, and the Thoughtz Code and links that open it.
- Survey Content
- the questions, titles, descriptions, logos, branding and other material a Survey owner supplies for a Survey.
3. Your licence to use the Platform
- 3.1While this Agreement is in force, we grant you a revocable, non-exclusive, non-transferable licence to use the Platform for the purposes it is designed for. For a Business, those purposes are its business purposes. For an App User, they are personal, non-commercial purposes.
- 3.2You must not copy, modify, reverse engineer, decompile, scrape, resell or build a competing product from the Platform, or try to get around any limit, security measure or moderation step, except to the extent the law allows you to despite this clause.
- 3.3We own the Platform and all intellectual property rights in it, including the Thoughtz name and marks, Thoughtz Codes and their designs, and the software. Apart from the licence in clause 3.1, and the licence to Results in clause B3, this Agreement gives you no rights in them.
- 3.4If you send us suggestions or feedback, we may use them freely and without any obligation to you.
4. Who owns Responses and Results, and how we use them
- 4.1Thoughtz owns all Responses and Results, and all intellectual property and other rights in them, from the moment they are created. This applies whoever created the Survey and whoever gave the Response. To the extent any of those rights would otherwise belong to you, you assign them to us, now and as they come into existence.
- 4.2To the extent the law allows, you consent to our using Responses and Results in any of the ways described in this clause 4, even if that use would otherwise infringe any moral right you hold in them.
- 4.3We may use, copy, store, analyse, combine with other data, publish, commercialise and create new works from Responses and Results for any purpose. Those purposes include operating and improving the Platform, research, benchmarking, public opinion reporting and insight products.
- 4.4Our promise to you. Whenever we use or disclose Responses or Results outside the Survey they were given to:
- (a) we will do so only in the form of Aggregated Results;
- (b) we will never disclose the identity of any Respondent, or anything we know identifies them, such as their name or email address;
- (c) we will not publish Aggregated Results for any group of fewer than three Respondents, so that a small group cannot be used to work out one person's answer; and
- (d) we will not name the Business or App User who ran the Survey as the source, unless they agree or the Results are already public through the Platform.
- 4.5Within the Platform itself, Results are shown to the Survey owner and, where the Survey's settings allow, to the public. They are shown only once the Survey has reached the minimum number of Responses we set, and they never include the identity of any Respondent. Free-text answers are shown as written, so Respondents should not include personal details in them (see clause C2.3).
- 4.6Survey owners keep ownership of their Survey Content. Each Survey owner grants us a perpetual, irrevocable, worldwide, royalty-free, sub-licensable licence to host, reproduce, display, adapt and publish their Survey Content:
- (a) to operate the Survey and the Platform; and
- (b) alongside the Results it produced, so that those Results can be understood.
- 4.7This clause 4 continues after this Agreement ends, and after any account is closed or deleted, whether it is a business account or an App account. Closing an account does not withdraw Responses or Results already given.
5. Content standards, screening and flagging
- 5.1All Survey Content, Responses and other material you put on the Platform must comply with our Acceptable Use Policy. We have zero tolerance for objectionable or abusive content and for users who post it.
- 5.2Automated screening. Every Survey is checked by an automated system, which uses AI, before it is published, and again whenever its content changes. The system may:
- (a) allow the Survey to be published;
- (b) refuse it, in which case it stays unpublished and we tell you why, usually with a suggested rewrite; or
- (c) allow it and refer it to us for review by a person.
- 5.3Flagging. Any Respondent can Flag a Survey question as inappropriate. Every Flag is reviewed by a person at Thoughtz. If a Survey receives Flags from several Respondents, it may be suspended automatically while that review takes place.
- 5.4If we reasonably believe material breaches this Agreement or the Acceptable Use Policy, or creates a legal or safety risk, we may:
- (a) refuse, edit or remove it;
- (b) suspend or end the Survey it belongs to; and
- (c) suspend or close the account responsible.
- 5.5If you think a screening or moderation decision is wrong, contact us at support@thoughtz.com. A person will review it.
- 5.6Screening and review help keep the Platform safe, but no system catches everything, and we are not obliged to monitor all content. The person who created content remains responsible for it.
- 5.7Discussions. Posts are not checked by a person or by AI before they appear. An automatic word filter refuses a Post that contains certain words. Anyone who can see a Post, other than its author, can report it, and every report is reviewed by a person at Thoughtz. We may remove a Post, and we may stop an account from posting in Discussions for a period or indefinitely. Clause C6 sets out the rules for Discussions in full.
6. AI Features
- 6.1The Platform uses AI for:
- (a) content screening, under clause 5.2;
- (b) the Survey Assistant, which suggests how to word Survey questions; and
- (c) AI Analysis, which writes a plain-English summary of a Survey's Results when the Survey owner asks for one.
- 6.2To provide AI Features, we send the relevant content to a third-party AI provider (currently Anthropic PBC). That content can include Survey Content and, for AI Analysis, Responses including free-text answers. We do not send the identity of any Respondent. Our provider may not use that content to train its models.
- 6.3AI output is generated automatically. It may be incomplete, inaccurate or out of date. An AI Analysis may be based on a sample of the free-text Responses rather than all of them. AI output is for information only and is not professional advice. You are responsible for any decision you make using it.
7. Privacy and data security
- 7.1We handle personal information in line with our Privacy Policy. Businesses never receive the identity of any Respondent through the Platform.
- 7.2We take reasonable steps to keep the Platform and the data in it secure. However, data travels over networks we do not control, and no system is completely secure. We cannot guarantee that data will never be lost, intercepted or accessed without authorisation.
- 7.3Data may be stored and processed outside Australia by us and our Third Party Providers.
8. Third Party Providers and links
- 8.1We use third parties to help run the Platform, including for hosting, databases, email, payments and AI (Third Party Providers). We may share material with them only as needed for them to provide those services.
- 8.2The Platform may link to websites and services run by others. We are not responsible for their content or conduct.
9. Availability and support
- 9.1We aim to keep the Platform available, but it may sometimes be unavailable, for example during maintenance or updates. We may change, add or remove features from time to time.
- 9.2For help, contact support@thoughtz.com. We will make reasonable efforts to respond.
10. Changes to this Agreement
- 10.1We may update this Agreement. If a change materially affects your rights, we will give you at least 14 days' notice by email or in the Platform before it takes effect.
- 10.2If you do not agree to a change, you may stop using the Platform and close your account before it takes effect. If you continue using the Platform after the effective date, you accept the change.
- 10.3No change will reduce the Credits or Survey slots you have already bought.
11. Suspension and termination
- 11.1You may stop using the Platform at any time, and you may ask us to close your account.
- 11.2We may suspend or close your account:
- (a) if you materially breach this Agreement or the Acceptable Use Policy;
- (b) if the law requires it; or
- (c) if we reasonably need to in order to protect other users, the public or the Platform.
- 11.3When an account closes, the licence in clause 3.1 ends. Clauses 4, 12 to 17 and any accrued rights continue.
12. Disclaimer
- 12.1Nothing in this Agreement excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded (Non-Excludable Rights).
- 12.2Subject to your Non-Excludable Rights, the Platform is provided "as is". We do not promise that it will be uninterrupted or error-free, or that any Results or AI output will be accurate or fit for a particular purpose.
13. Liability
- 13.1If we fail to comply with a Non-Excludable Right in relation to services that are not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited, where the law allows, to supplying the services again or paying the cost of having them supplied again.
- 13.2Subject to clause 13.1 and your Non-Excludable Rights, our total liability to you in connection with this Agreement is limited to the greater of AUD $100 and the total amount you paid us in the 12 months before the claim arose.
- 13.3Subject to your Non-Excludable Rights, neither of us is liable to the other for loss of profit, revenue, opportunity or data, or for any indirect or consequential loss.
- 13.4Our liability is reduced to the extent that you, or a third party we do not control, caused or contributed to the loss.
14. Indemnity
- 14.1You indemnify us against any claim, loss or cost, including reasonable legal costs, to the extent it arises from:
- (a) your breach of this Agreement or the Acceptable Use Policy;
- (b) Survey Content you supplied; or
- (c) your breach of any law.
15. Disputes and governing law
- 15.1If either of us has a dispute under this Agreement, that party must first give the other written notice of it, with details. Within 7 days, we will each make a genuine attempt to resolve it in good faith.
- 15.2If the dispute is not resolved within 30 days of the notice, either of us may refer it to mediation in Brisbane. The mediator will be one we agree on or, if we cannot agree, one nominated by the President of the Queensland Law Society. We will share the mediator's costs equally and each pay our own costs.
- 15.3Neither of us may start court proceedings, except for urgent interim relief, until we have followed this clause 15.
- 15.4This Agreement is governed by the laws of Queensland, Australia. We each submit to the non-exclusive jurisdiction of the courts of Queensland. This does not remove any right you have to bring proceedings where you live under laws that apply to you.
16. Notices
- 16.1You can contact us at support@thoughtz.com or by post at Level 1, 241 Adelaide St, Suite #1187, Brisbane QLD 4000.
- 16.2We will contact you at the email address on your account, or through the Platform. You must keep your contact details up to date.
17. General
- 17.1We may transfer this Agreement to a buyer of all or part of our business, or to a related company, on notice to you, provided your rights under it are not reduced. You may not transfer your rights under it without our written consent.
- 17.2If any part of this Agreement is invalid or unenforceable in a jurisdiction, it is severed for that jurisdiction only, and the rest continues to apply.
- 17.3A waiver is effective only if it is in writing. A failure or delay in exercising a right is not a waiver.
- 17.4This Agreement, together with the Privacy Policy and Acceptable Use Policy, is the entire agreement between us about its subject matter.
18. Apple App Store
- 18.1This clause applies if you downloaded the App from the Apple App Store:
- (a) This Agreement is between you and us, not Apple. We, not Apple, are responsible for the App and its content.
- (b) Your licence to use the App is limited to Apple-branded devices you own or control, as permitted by Apple's Usage Rules.
- (c) Apple has no obligation to provide maintenance or support for the App.
- (d) If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent the law allows, Apple has no other warranty obligation for the App.
- (e) We, not Apple, are responsible for dealing with any claim relating to the App, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims and intellectual property infringement claims.
- (f) You confirm that you are not located in a country subject to a US Government embargo, and that you are not on any US Government list of prohibited or restricted parties.
- (g) You must comply with any applicable third-party terms when using the App.
- (h) Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.
Part B — Additional terms for Businesses
B1. Your business account
- B1.1You must give accurate business details and keep them up to date. You must keep your login details and any second factor secure.
- B1.2You are responsible for everything done through your account, including by anyone you allow to use it.
B2. Your Surveys
- B2.1You are responsible for your Survey Content. You confirm that you have the right to use it, and that it and your use of the Platform comply with the law and the Acceptable Use Policy.
- B2.2You must not:
- (a) ask Respondents for personal or sensitive information, such as names, contact details, or health or financial information;
- (b) try to identify any Respondent, or anyone who writes a Post, or re-identify anyone from Results; or
- (c) misrepresent who is running a Survey or why.
- B2.3Anyone who scans a Thoughtz Code or opens a Survey link can see the Survey. If you list a Survey in the App's Browse Menu, it can be found by any App User.
- B2.4Results are public in the App by default. You can make a Survey's Results unavailable to the public in its settings.
- B2.5Discussions. A Survey whose Results are public also has a Discussion, where people who answered it can write Posts about it under their Handles (see clause C6). You can read the Discussion on your own Survey in the Business Portal, and report a Post from there, but you cannot post in it. A Survey whose Results are not public has no Discussion. Posts are not Responses and are not part of Results.
B3. Access to your Results
- B3.1We grant you a non-exclusive, non-transferable, royalty-free licence to access, use, copy and share the Results of your own Surveys for your business purposes, for as long as your account is open.
- B3.2You may keep and continue to use copies of Results that you made while your account was open.
- B3.3Results are available once a Survey reaches our minimum number of Responses. Some features, such as AI Analysis, need more Responses.
B4. Fees and payment
- B4.1A business account includes one free Survey slot and an included number of Responses in each monthly period, as described on our pricing page.
- B4.2You can choose to buy extra Survey slots, add-ons (such as a Browse Menu Listing, Custom Branding or a Browse Channel) and Credits. Prices are shown before you pay, are in Australian dollars and are exclusive of any applicable taxes. Payment is processed by our payment provider, Stripe.
- B4.3Every purchase is a one-off payment. There are no subscriptions, and nothing renews automatically.
- B4.4A Survey slot stays with your account for as long as it is open. Add-ons apply to the Survey you bought them for, for that Survey's life.
- B4.5Credits do not expire. They can be used on any of your Surveys, cannot be transferred and have no cash value. When a Survey uses up its included Responses for the period, further Responses use your Response Credits. If you have none, the Survey stops accepting Responses until the next period or until you buy more.
- B4.6We may change our prices at any time. A change does not affect anything you have already paid for.
- B4.7We may give you Survey slots or Credits free of charge. Free grants are subject to this Agreement in the same way as purchases.
B5. Refunds
- B5.1Purchases are non-refundable, except:
- (a) where your Non-Excludable Rights entitle you to a refund; or
- (b) if an AI Analysis fails to complete, in which case the AI Analysis Credit is returned to your balance automatically.
- B5.2If we remove a Survey because it breached this Agreement or the Acceptable Use Policy, add-ons bought for that Survey are not refunded, except as your Non-Excludable Rights require.
B6. Closing a business account
- B6.1When you close your business account, your Surveys stop. Responses and Results remain ours under clause 4. Unused Credits are forfeited, except as required by law.
B7. Incentives and promotions
- B7.1If you offer Respondents any incentive, prize or promotion in connection with a Survey, you are solely responsible for it, including for complying with any trade promotion law. Thoughtz is not a promoter.
Part C — Additional terms for App Users
C1. Your App account
- C1.1To register, you give us an email address and choose a PIN. You may also give demographic information such as your gender and birth year. We use that information only to produce Aggregated Results and, in the case of your birth year, to apply the age limits in clauses 1.6 and C6.1.
- C1.2You must give accurate information, keep your PIN secure and have only one App account.
- C1.3When you register, we give you a Handle. It is the name shown on your Posts (see clause C6.2).
C2. Answering Surveys
- C2.1The Business or App User who runs a Survey never receives your name, email address or other contact details. Your answers are shown to them only as part of the Survey's Results.
- C2.2Once you submit a Response, it belongs to Thoughtz under clause 4 and forms part of the Survey's Results.
- C2.3Free-text answers may be shown to the Survey owner, and to the public where the Survey's Results are public, exactly as you wrote them. They may also be processed by our AI provider under clause 6. Do not include your name, contact details or anything else that identifies you or anyone else in a free-text answer.
- C2.4Answer honestly. Do not use automated means, or try to answer the same Survey more than the Platform allows.
C3. Deleting your App account
- C3.1You can delete your App account at any time from the App. We will then delete your account details as described in our Privacy Policy.
- C3.2Responses you have already given are not linked to your identity in Results. They remain ours under clause 4, and may continue to be included in Results and Aggregated Results after your account is deleted.
- C3.3Your Posts are treated the opposite way: they are not Responses, and they are deleted when you delete your App account, as clause C6.9 explains.
C4. Your own Surveys
- C4.1App Users can create free Surveys, within the limits shown in the App.
- C4.2When you create a Survey, you are its owner. Clause 5 and clauses B2.1, B2.2 and B2.4 apply to you as they do to a Business. You have the same licence to your own Survey's Results as clause B3 gives a Business.
C5. Flagging
- C5.1If you think a Survey question is inappropriate, Flag it in the App. A person at Thoughtz will review it.
- C5.2Do not Flag content in bad faith or to disrupt a Survey. Misusing Flags is a breach of this Agreement.
C6. Discussions
- C6.1Who can take part. Only a Survey whose Results are public has a Discussion. You can read and write Posts in it if you are at least 16 years old and you have either answered the Survey or created it as your own Survey. You need an App account to take part: guests cannot. We apply the age limit using the birth year you gave when you registered, and we do not otherwise check your age. By taking part, you confirm that you are at least 16.
- C6.2Your Handle. We give you a Handle when you register. It is made up automatically of two words and a number, and it is not based on your name. Your Handle appears on every Post you write, and you use the same Handle in every Discussion, so your Posts in different Discussions can be connected to each other. If you created the Survey, your Posts in its Discussion also carry a "Creator" tag. You can replace your Handle with another generated one through Update Handle on My Account, at most once every 30 days, and your earlier Posts then show the new Handle. A Handle that has been used is never given to anyone else. Your Handle is never shown with your Responses.
- C6.3Who can see your Posts. Your Posts, with your Handle, can be seen by the other people who can take part in that Discussion, by the Survey's owner and by us. A Business can read the Discussion on its own Survey in the Business Portal, but cannot post in it (see clause B2.5).
- C6.4Writing Posts. A Post is plain text of up to 500 characters. Links are not clickable and formatting is not shown. Posts are not checked by a person or by AI before they appear, but an automatic word filter refuses a Post that contains certain words. You can write up to 10 Posts in any hour. You can delete your own Post, but you cannot edit it. If you delete a Post that starts a conversation other people have replied to, it is replaced by "Comment deleted" so that their replies keep their place; a reply you delete simply disappears.
- C6.5What you write. Your Posts must follow the Acceptable Use Policy. Do not include your own or anyone else's name, contact details or anything else that identifies a person, and do not try to work out who is behind a Handle.
- C6.6Reporting and blocking. If you think a Post breaks this Agreement or the Acceptable Use Policy, report it in the App. You can report each Post once, and a person at Thoughtz reviews every report. Report in good faith: misusing reports is a breach of this Agreement. You can also block another person in a Discussion, so that you no longer see their Posts. Blocking is private, and you can undo it from My Account.
- C6.7What we may do. We may remove a Post that breaks this Agreement or the Acceptable Use Policy. A removed Post is replaced by "Comment removed — it broke the community rules." We keep the text of a removed Post, out of sight, as the record of that decision until you delete your account. We may also stop your account from posting in Discussions, for a period or indefinitely, and that restriction continues if you delete your account and register again. While a Survey is suspended for review, its Discussion is closed to new Posts. Clause 5 also applies to Posts.
- C6.8Who owns your Posts. You keep ownership of your Posts. Because a Post is not a Response, clause 4 does not apply to it. You grant us a worldwide, royalty-free, non-exclusive licence to host, store, reproduce and display your Posts to the people described in clause C6.3, and to review, moderate and remove them, for as long as each Post exists on the Platform. We may sub-license those rights only to our Third Party Providers, as far as they need them to run the Platform.
- C6.9Deleting your account. When you delete your App account, we delete your Posts, the reports you made and your blocks. If one of your Posts started a conversation that other people replied to, it is replaced by an anonymous "Comment deleted" marker so that their replies keep their place. This is the opposite of your Responses, which remain part of Results (clause C3.2). The Handles you used are kept only so that they are never given to anyone else, and are no longer linked to you.

Acceptable use policy
The short version. Ask and answer honestly. Don't use Thoughtz to abuse, expose or deceive anyone. Surveys never ask people who they are. We have zero tolerance for objectionable content, and a person reviews every report.
1. About this policy
- 1.1This policy sets the rules for everything you do on the Thoughtz Platform: the App, the Business Portal, Thoughtz Codes, thoz.io links and thoughtz.com. It applies to Survey Content (questions, answer options, titles, descriptions and branding), to answers, to discussion posts, and to how you use the Platform.
- 1.2It forms part of our Terms of Service, and the terms defined there have the same meaning here. Clause 10 of the Terms explains how we may change this policy and how we will tell you first.
2. Content that is not allowed
No Survey Content, answer, discussion post or other material on the Platform may contain, encourage or facilitate any of the following.
- 2.1Hate. Slurs, or content that demeans people for their race, religion, sex, gender identity, sexual orientation, disability, age or nationality.
- 2.2Harassment. Content meant to demean, humiliate or single out a particular person. Naming someone in a neutral way is fine, for example asking who served you or whether a staff member was helpful. Naming someone in demeaning or loaded terms is not.
- 2.3Allegations presented as fact. Questions whose wording states or implies that a real person has committed a crime or serious misconduct, for example "Do you think X took bribes?". Every respondent is then answering a question that assumes the allegation is true.
- 2.4Sexual content. Sexually explicit material, or any sexual content involving a minor.
- 2.5Violence. Threats, incitement to violence, or promoting self-harm or suicide.
- 2.6Illegal activity. Offering, requesting or helping with illegal goods, services or activity.
- 2.7Personal information. Asking anyone to identify themselves or give sensitive details. See section 3.1.
- 2.8Profanity. Strong obscenity in Survey Content or in discussion posts. Mild or incidental language in an ordinary question or post is not a breach, but the automatic word filter on discussion posts refuses any post containing a word on its list, whether or not it is a breach (see section 6.1).
- 2.9Anything else unlawful, including content that infringes someone's intellectual property or privacy, or that is defamatory.
Context matters. Normal vocabulary for a lawful industry is not a breach: a clinic asking about symptoms, a bar asking about alcohol, or a funeral home asking about bereavement.
3. Rules for Survey owners
These apply to Businesses and to App Users who create Surveys.
- 3.1Never ask who someone is. Anonymity is Thoughtz's core promise. Do not ask for anything that identifies a person, including:
- (a) a full name, home address, phone number or email address;
- (b) a government ID number;
- (c) bank or card numbers; or
- (d) passwords or account credentials.
- 3.2Be honest about the Survey. Do not misrepresent who is running it or why. Do not impersonate another person or business. Do not use a Survey to phish, advertise, spam, or collect contacts.
- 3.3Respect respondents. Do not try to identify anyone who answered your Survey, or to work out who someone is from your results.
- 3.4Get around nothing. Do not reword a refused Survey to slip the same content past screening, or use one Survey to carry content another was refused for.
- 3.5Incentives. If you offer anything in return for answers, you are responsible for it and for complying with any law that applies to it (see Terms clause B7).
4. Rules for respondents
- 4.1Answer honestly and as yourself. Use one App account only. Do not use bots, scripts or other automated means, and do not try to answer a Survey more times than it allows.
- 4.2Written answers must follow section 2. Do not use them to abuse, threaten or expose anyone. Do not include your own or anyone else's name, contact details or other identifying information. Written answers can be seen by the Survey owner and, where results are public, by other people.
- 4.3Flag in good faith. Flag a question when you believe it breaks this policy. Do not flag to disrupt a Survey you simply disagree with.
- 4.4Discussion posts must follow section 2. This applies to everyone who posts in a Survey's discussion, including the person who created the Survey.
- 4.5Do not identify yourself or anyone else. Do not put your own or anyone else's name, contact details or other identifying information in a post, and do not try to work out who is behind a handle.
- 4.6Do not harass or impersonate. Do not use posts to abuse, threaten or single out anyone, and do not pretend to be another person, a business or Thoughtz.
- 4.7No advertising or spam. Do not use posts to advertise or promote anything, to collect contact details, or to post the same thing over and over.
- 4.8Report in good faith. Report a post when you believe it breaks this policy. Do not report a post to silence someone you simply disagree with.
5. Using the Platform properly
- 5.1Share Thoughtz Codes and Survey links as widely as you like. Do not:
- (a) interfere with the Platform, or overload it by sending excessive requests;
- (b) try to get around security, limits, payment or moderation;
- (c) access data or accounts that are not yours;
- (d) upload viruses or other malicious code;
- (e) scrape, harvest or copy content or results by automated means;
- (f) resell or sublicense access to the Platform, or use it to build a competing product; or
- (g) claim or suggest that you are affiliated with, endorsed by, or acting for Thoughtz when you are not.
6. How this policy is enforced
- 6.1Screening. Every Survey is checked by an automated system, which uses AI, before it is published and whenever its content changes. A Survey that breaks section 2 or 3 is refused and stays unpublished, and you are told why. Content the system is unsure about may be published and passed to a person for review. Discussion posts are not screened this way: they are not checked by a person or by AI before they appear. An automatic word filter refuses a post that contains a word on its list, and that post is not published.
- 6.2Reporting. Anyone answering a Survey can flag a question in the App. Anyone who can see a discussion post, other than its author, can report it in the App, once, and a business can report a post in the discussion on its own Survey from the Business Portal. To report a written answer, or anything else, email support@thoughtz.com. Every report is reviewed by a person. A Survey flagged by several different people may be suspended automatically until that review is done.
- 6.3What we may do. If we reasonably believe something breaks this policy, we may, depending on how serious it is and whether it has happened before:
- (a) ask you to change it;
- (b) refuse, edit or remove it;
- (c) suspend or end the Survey;
- (d) stop your account from creating Surveys;
- (e) suspend or close your account; or
- (f) stop your account from posting in discussions, for a period or indefinitely.
- 6.4Zero tolerance. Content that sexualises a minor, threatens violence, or is otherwise seriously harmful is removed immediately. The account responsible may be closed without warning. Where the law requires, or where someone may be at risk, we report it to the police or other authorities.
- 6.5Review. If you think we got a decision wrong, email support@thoughtz.com. A person will look at it again.
